DEFINICIÓN DE PSI: Entendemos por Personal Shopper Inmobiliario a todo aquel profesional que, en el ejercicio de su actividad inmobiliaria opta por un posicionamiento unilateral al lado del cliente comprador comprometiéndose en la defensa de sus intereses y el cumplimiento de sus expectativas en cuanto a la operación inmobiliaria encomendada. El PSI busca, encuentra, negocia en nombre y desde los intereses del Cliente Comprador para el cual trabaja en exclusiva.

Todas las empresas o los profesionales adscritos a ésta Asociación, desde el momento de incorporarse a la misma, se comprometen con las siguientes reglas de comportamiento, ética y actuación siempre que estén alineadas con la legislación vigente y no supongan menoscabo alguno de las mismas.

1.- Posicionamiento y representación: El Personal Shopper Inmobiliario, mediante la firma del correspondiente contrato, se posiciona unilateralmente y en exclusiva al lado del cliente comprador cuyos intereses protege y representa. El profesional actuará en todo momento alineado con los deseos, las expectativas y las necesidades del cliente al cual representa y buscando las mejores alternativas y condiciones posibles para el cierre de la operación.

2.- Legislación y Asesoramiento: El Personal Shopper Inmobiliario deberá conocer y cumplir estrictamente la legislación vigente tanto a nivel nacional como local del lugar donde ejerza su actividad. Deberá informar convenientemente al cliente de dicha legislación así como, de las leyes de protección de datos y, si procede, de la política de prevención y blanqueo de capitales a nivel nacional e internacional.

Asimismo deberá conocer en todo momento e informar a su cliente de las condiciones del mercado así como la situación legal y urbanística de cada inmueble por el que éste se interese.

3.- Integridad, ética, transparencia y secreto profesional: Todas las empresas o profesionales asociados se comprometen expresa y activamente con una práctica de la actividad de PSI basada en la integridad, la ética y el compromiso con el cliente. El PSI se obliga a guardar la necesaria discreción y prudencia con respecto a los clientes a los que representa y a la información que necesariamente éste le confía.

Se compromete a ser digno receptor de ésta confianza y a actuar en todo momento con profesionalidad, transparencia, sinceridad y lealtad abriendo y fomentando vías de comunicación efectiva, veraz y dinámica con su cliente.

4.- Conflicto de Intereses: La representación simultanea del cliente comprador y del vendedor o propietario del inmueble excluye de manera explícita y absoluta el ejercicio del PSI al generar un conflicto de intereses que inhabilita total y absolutamente para el ejercicio de la actividad.

No obstante, los Agentes o las Agencias Inmobiliarias que decidan incorporar a su negocio el servicio de Personal Shopper a pesar de disponer de producto en cartera y por consiguiente contrato de representación y defensa de intereses del cliente vendedor, podrán hacerlo siempre que se comprometan y cumplan con las siguientes pautas de procedimiento:

a) Si la Agencia Inmobiliaria o el profesional disponen de producto en cartera que se ajuste a las necesidades de búsqueda manifestadas por el cliente comprador, están obligadas a ofrecerlo antes de firmar el contrato de PSI y solamente se ofrecerá dicho contrato cuando fehacientemente se pueda garantizar al cliente que se ha de iniciar una búsqueda del bien inmueble solicitado.

b) La operativa habitual consistirá en que una vez firmado el contrato de búsqueda con el cliente comprador, la agencia o el PSI entrarán en contacto con otras agencias o profesionales para localizar el producto. Cada uno, posicionado en la defensa de los intereses de su cliente negociará para llegar al mejor acuerdo posible. A la firma del acuerdo, cada uno percibirá los honorarios pactados con sus respectivos clientes.

c) En el ejercicio del PSI, la agencia Inmobiliaria o el profesional garantizarán expresamente al cliente que no perciben ningún tipo de honorarios de parte del cliente vendedor. Si durante la búsqueda del producto el Profesional o la Agencia captan directamente el inmueble de un propietario particular, siguiendo las normas de ética y transparencia a las que les compromete la vinculación a ésta Asociación, deberán comunicar a ambas partes la situación y aplicar a ambos el 50% de los honorarios estipulados.

5.- Contrato de PSI: Las agencias inmobiliarias o los profesionales adscritos a esta asociación, aplicarán en el ejercicio del Personal Shopper Inmobiliario el correspondiente modelo de contrato propuesto por la Asociación o, en su defecto, cualquier otro siempre que recoja la filosofía y los principios y valores del mismo. Con el fin de proporcionar a nuestros clientes una mejor comprensión de la actividad del PSI y una mayor garantía de nuestro servicio, el contrato de PSI deberá llevar incorporado como anexo el presente código deontológico que representa el compromiso último y definitivo con nuestra filosofía y valores.

6.- Cumplimiento de éste Código: Las normas y directrices recogidas en el presente Código Deontológico serán de obligado cumplimiento para las empresas inmobiliarias y agentes miembros de la APSI. La junta rectora velará por el cumplimiento y la preservación de dichas normas expulsando a los miembros que las incumplan.
